2. Acceptance of Terms
By accessing our website, submitting a document intake form, booking a consultation, or using any NA Income Tax LLC service, you agree to these Terms of Service in full. If you do not agree, please discontinue use of our website and services immediately.
NA Income Tax LLC reserves the right to update these Terms at any time. Continued use of our services after any revisions constitutes your acceptance of the updated Terms. We will notify clients of material changes via email or notice on our website.
3. Age Requirement (18+)
You must be at least 18 years of age to independently use NA Income Tax LLC services, create a client account, or opt in to any SMS messaging program.
By using our services or opting in to receive SMS communications, you confirm that you are 18 years of age or older.
NA Income Tax LLC does not knowingly collect personal information from children under 13 without parental consent. If we discover that a minor under 13 has submitted personal information independently, we will delete it immediately.
4. Tax Preparation Services & Scope
NA Income Tax LLC provides the following services:
- Individual and business federal and state income tax preparation
- Electronic filing (e-file) of federal and state tax returns
- Tax planning and consultation
- Prior-year and amended return preparation
- Extension filing
- Assistance responding to IRS and state tax authority notices
- Bookkeeping and support services for small businesses (where applicable)

5. SMS / Text Messaging Policy — A2P 10DLC
NA Income Tax LLC operates an SMS messaging program registered with The Campaign Registry (TCR) under the A2P 10DLC framework.
5.1 SMS Use Cases
Transactional / Service Messages (service opt-in required):
- Appointment scheduling confirmations and reminders
- Document request and missing-document notifications
- Return status and e-file confirmation updates
- Client support responses
Promotional / Seasonal Messages (separate opt-in required):
- Tax season reminders and filing deadline alerts
- New service announcements
- Seasonal tax-planning tips and promotions
5.2 Message Frequency
- Transactional: Up to 5 messages per engagement or filing event
- Promotional / Seasonal: Up to 4 messages per month
- Message frequency varies based on filing activity and account needs
5.3 Message & Data Rates
Message and data rates may apply depending on your mobile carrier plan. NA Income Tax LLC does not charge separately for SMS communications. Standard carrier rates apply.
5.4 Opt-Out Instructions
You may stop receiving SMS at any time using any of the following methods:
- Reply STOP to any message — you will receive one final confirmation, then no further messages will be sent.

Opting out of SMS does not affect your engagement or client services. You may re-subscribe at any time by texting START or submitting a new consent form.

5.6 Carrier Liability Disclaimer
Carriers are not liable for delayed or undelivered messages. Message delivery depends on your mobile carrier and network availability and is outside NA Income Tax LLC’s control.
5.7 Mobile Info Sharing
NO MOBILE INFORMATION WILL BE SHARED WITH THIRD PARTIES/AFFILIATES FOR MARKETING/PROMOTIONAL PURPOSES.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
SMS data is shared only with our SMS platform provider under strict confidentiality, solely to operate the messaging program. SMS opt-in data and mobile phone numbers will NOT be sold, rented, or shared with third parties for marketing purposes.
5.8 Age Restriction for SMS
You must be 18 years of age or older to opt in to any NA Income Tax LLC SMS program. By opting in, you confirm you meet this age requirement.
5.9 Consent Not Required
SMS opt-in is never required to schedule a consultation, receive tax preparation services, or access any service.

6. Appointments, Document Submission & Deadlines
6.1 Scheduling
Appointments and document intake may be scheduled by:

All appointments and engagements must be confirmed by NA Income Tax LLC staff before they are considered booked. Online form submissions are requests only and do not guarantee a confirmed appointment until you receive a confirmation from our office.
6.2 Cancellations & No-Shows
- 24+ hours before appointment: Full cancellation at no charge
- Less than 24 hours before appointment: A cancellation/late fee may apply
- No-show (client fails to appear without notice): No-show fee may apply
Cancellations must be submitted by calling (305) 381-5362 or emailing info@naincometax.com. Repeated no-shows or late cancellations may result in discharge as a client at NA Income Tax LLC’s discretion.
6.3 Filing Deadlines
It is the client’s responsibility to submit complete and accurate documents with sufficient time before applicable IRS and state filing deadlines. Late or incomplete document submission may result in the need to file an extension, and may incur additional fees. We are not responsible for penalties, interest, or missed deadlines resulting from late or incomplete client document submission.
7. Payments, Fees & Refunds
7.1 Payment
- All preparation fees are due at or before the time your return is filed, unless another arrangement is agreed to in writing
- We accept cash, major credit/debit cards, and, where offered, refund-transfer/bank-product payment options
- Payments are processed through secure third-party PCI-compliant processors
- Outstanding balances may be sent to collections after 90 days
7.2 Refunds from Tax Authorities
NA Income Tax LLC does not control, guarantee, or issue refunds from the IRS or any state tax authority. Refund timing and amount are determined solely by the applicable tax authority. We are not responsible for delays, offsets, or adjustments made by the IRS or state agencies.
7.3 Fee Disputes
Any dispute regarding preparation fees must be raised in writing within 30 days of invoicing. Fees already paid for completed and filed returns are non-refundable except as required by law.
8. Virtual / Remote Tax Preparation Services
NA Income Tax LLC may offer virtual consultations and remote document submission subject to applicable state and federal law. By using remote services, you acknowledge that:
- You are responsible for ensuring a secure and private environment and connection when submitting sensitive documents
- Technical issues beyond our control may affect virtual session quality or document transmission
- You are responsible for using the secure client portal or method we designate, rather than unsecured email, for sensitive documents (SSNs, account numbers, etc.)
- A follow-up in-person or additional consultation may be recommended
Virtual engagements are subject to the same payment and cancellation policies as in-person appointments.
9. Client Responsibilities
As a client of NA Income Tax LLC, you agree to:
- Provide accurate, complete, and truthful information and supporting documents for your tax return
- Notify us promptly of any changes to your contact information, income, or filing status
- Review your return carefully before signing and authorizing e-file
- Retain copies of your filed returns and supporting documents as required by law
- Pay all applicable fees at the time of service
- Treat our staff with respect — abusive or threatening behavior may result in termination of the engagement
- Arrive on time for scheduled appointments or notify us promptly if you need to cancel or reschedule
You, not the preparer, are ultimately responsible for the accuracy of the information reported on your tax return and for any resulting tax liability, penalties, or interest arising from inaccurate or incomplete information you provide.
10. Confidentiality & Safeguarding of Taxpayer Data
NA Income Tax LLC safeguards taxpayer information in accordance with IRS Publication 4557 (Safeguarding Taxpayer Data), the Gramm-Leach-Bliley Act (GLBA) Safeguards Rule, and applicable Florida law. We do not disclose your tax return information to third parties except as permitted or required by law, or with your written consent (IRC §7216).
Under applicable law, you have the right to:
- Request a copy of your filed tax returns
- Request that we correct inaccurate information we hold about you
- Ask how your information is used and shared
- File a complaint if you believe your information was mishandled
Requests must be submitted in writing to: info@naincometax.com. We respond within a reasonable time as required by applicable law. A processing fee may apply for document requests.
11. Limitation of Liability & Tax Disclaimer
IMPORTANT — TAX DISCLAIMER: NA Income Tax LLC prepares returns based on information and documents provided by the client. The information on our website is for general informational purposes only and does not constitute tax, legal, or financial advice. Outcomes depend on many factors outside our control, including IRS/state processing and the accuracy of client-provided information.
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, or consequential damages arising from:
- Reliance on information provided on our website
- Delays caused by factors outside our control, including IRS/state processing times
- Client failure to provide accurate or complete information or documents
- SMS delivery failures caused by carrier network issues
- Third-party service failures (payment processors, e-file transmitters, etc.)
Our total liability for any claim related to our services shall not exceed the amount paid by the client for the specific service giving rise to the claim. Nothing in these Terms limits liability for gross negligence, willful misconduct, or violations of applicable law.
12. Governing Law & Compliance
These Terms of Service are governed by the laws of the State of Florida, USA. Disputes are subject to the jurisdiction of the courts located in Florida.
NA Income Tax LLC’s SMS program complies with:
- CTIA Messaging Principles and Best Practices
- FCC Telephone Consumer Protection Act (TCPA)
- FCC One-to-One Consent Rule (effective January 27, 2026)
- TCR A2P 10DLC registration requirements
- IRS Circular 230 and applicable IRS preparer regulations
- Gramm-Leach-Bliley Act (GLBA) Safeguards Rule
- Florida state law applicable to tax preparation services
13. Changes to These Terms
We may update these Terms of Service at any time. When material changes occur, we will:

- Post the revised Terms on our website
- Notify clients by email for significant changes where required
Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
