1. Who We Are

NA Income Tax LLC (“NA”, “we”, “our”, or “us”) is a tax preparation firm operating in the State of Florida, United States of America.

We operate https://naincometax.com and provide individual and business tax preparation, e-filing, and related consulting services to clients located at 1830 NW 7th St Suite #202, Miami, FL 33125 and remotely.

As a tax preparation service, we are subject to IRS Publication 4557 (Safeguarding Taxpayer Data), the Gramm-Leach-Bliley Act (GLBA) Safeguards Rule, IRC §7216, and applicable Florida privacy law, in addition to CTIA and A2P 10DLC requirements for SMS communications.

As a paid tax return preparer, we collect and maintain tax return information as part of preparing and filing your return. 3. How We Use Your Information

NA Income Tax LLC uses the information we collect for the following purposes:

  • To schedule and confirm consultations and appointments
  • To prepare, review, and file your federal and state tax returns
  • To send appointment reminders, document requests, and filing status notifications
  • To send SMS/text messages to clients who have opted in (see Section 4)
  • To process payments for our services
  • To respond to inquiries, complaints, and support requests

  • To comply with IRS regulations, legal obligations, and carrier regulations
  • To send seasonal tax reminders and communications to clients who have consented

We will not use your personal information for any purpose incompatible with those described in this Privacy Policy without your prior consent.

4. SMS / Text Messaging Data

IMPORTANT — A2P 10DLC & CTIA Compliance: This section governs the collection and use of data specifically related to our SMS/text messaging program, in compliance with A2P 10DLC requirements and CTIA guidelines.

4.1 Opt-In Consent

NA Income Tax LLC collects SMS consent through the following methods:

(a) Web Form

Clients check unchecked, optional checkboxes on our appointment request or contact form with the following disclosures:

Checkbox 1 — Non-marketing (Appointment & Service notifications):

“I consent to receive non-marketing text messages from NA Income Tax LLC at the phone number provided above, including appointment reminders, confirmations, document requests, and filing status updates. Message frequency may vary. Message & data rates may apply. Text HELP for assistance, reply STOP to opt out.”

Checkbox 2 — Promotional / Seasonal communications (optional, separate consent):

“I also consent to receive tax-season reminders, promotional offers, and seasonal tips from NA Income Tax LLC. This is optional and separate consent. Frequency: up to 4 messages per month. Msg & Data rates may apply. Reply STOP to cancel.”

Neither checkbox is pre-selected. Neither is required to submit the form or schedule an appointment. SMS consent is NEVER required as a condition of receiving tax preparation services.

(b) Verbal Consent

When calling to schedule an appointment, our staff obtains and documents verbal SMS consent before proceeding.

(c) Written / Paper Form

Clients may provide written SMS consent through their new client intake paperwork. Signed forms are retained for a minimum of 4 years.

4.2 Types of SMS Messages

Transactional / Service Messages — sent to clients with active appointments or engagements:

  • Appointment scheduling confirmations and reminders
  • Document request and missing-document notifications
  • Filing status and e-file confirmation updates
  • Client support responses

Promotional / Seasonal Messages — sent ONLY with separate explicit opt-in:

  • Tax season and deadline reminders
  • New service announcements
  • Seasonal promotions

4.3 Message Frequency & Costs

  • Transactional: Up to 5 messages per engagement or filing event
  • Promotional / Seasonal: Maximum 4 messages per month
  • Message and data rates may apply (carrier-dependent)
  • NA Income Tax LLC does not charge separately for SMS

4.4 How to Opt Out

You may stop receiving SMS messages at any time by:

  • Replying STOP to any text message from us
  • Replying HELP for support information
  • Emailing: info@naincometax.com
  • Calling: (305) 381-5362

After opting out, you will receive one final confirmation and no further messages. You may re-subscribe by texting START or submitting a new consent form. Opting out of SMS does not affect your tax preparation services.

4.5 SMS Data — No Third-Party Sharing

YOUR SMS OPT-IN DATA WILL NOT BE SOLD, RENTED, OR SHARED WITH THIRD PARTIES FOR MARKETING OR PROMOTIONAL PURPOSES.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

SMS data may be shared only with our SMS technology platform provider under a strict confidentiality agreement, solely to operate the messaging program on our behalf.

5. Confidentiality of Tax Return Information

As a paid preparer, NA Income Tax LLC is subject to IRC §7216, which restricts the use and disclosure of tax return information without your written consent. We are also subject to the GLBA Safeguards Rule and IRS Publication 4557 (Safeguarding Taxpayer Data).

We do not use or disclose your tax return information for purposes other than preparing and filing your return, except: (a) with your written consent, (b) as required by law or court order, or (c) to the extent necessary to provide services on our behalf under a confidentiality agreement (e.g., our e-file transmitter or software provider).

6. How We Share Your Information

We may share your information with:

  • The IRS and applicable state tax authorities, as required to file your return
  • E-file transmitters and tax preparation software providers, solely to prepare and transmit your return
  • Payment processors, solely to process payment for our services
  • Our SMS platform provider, solely to operate our messaging program
  • Professional advisors (e.g., our accountant or attorney) under confidentiality obligations
  • Law enforcement or regulators, where required by law

We do NOT sell your personal information or tax return information to third parties.

7. Data Retention

We retain client tax records and supporting documents for a minimum of the period required by IRS recordkeeping rules (generally at least 3 years, and up to 7 years for certain records), and SMS consent records for a minimum of 4 years. We may retain information longer where required by law or legitimate business need.

8. Cookies & Tracking Technologies

Our website may use cookies and similar technologies to operate core site functionality, remember preferences, and understand site usage. You can control cookies through your browser settings; disabling cookies may limit some website functionality.

We implement administrative, technical, and physical safeguards designed to protect your personal and tax information in accordance with IRS Publication 4557 and the GLBA Safeguards Rule, including secure document transmission methods, access controls, and staff confidentiality training. No method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.

13. Changes to This Policy

We may update this Privacy Policy at any time. When material changes occur, we will:

  • Update the “Last Updated” date at the top of this page
  • Post the revised Policy on our website
  • Notify clients by email for significant changes where required

Continued use of our services after changes are posted constitutes acceptance of the revised Policy.
